Terms of Sale

Article 1 — Purpose

These Terms of Sale apply to subscriptions to the paid "Creator" and "Pro" plans offered on S Prompt Generator, published by Maxence DAVO. They supplement the Terms of Use.

Article 2 — Description of plans and pricing

Prices are shown in euros, all taxes included. The publisher reserves the right to change its pricing at any time; the new pricing will only apply to subscriptions or renewals starting after it takes effect, with prior notice given to current subscribers.

Article 3 — Subscription and payment

Subscriptions are taken out online, by credit card, via the secure payment provider Stripe. By confirming an order, the user acknowledges having read and accepted these Terms of Sale.

Payment is automatically charged on each monthly billing date until the subscription is cancelled. No banking data is stored or processed by S Prompt Generator: this is handled entirely by Stripe.

Article 4 — Duration, renewal, and cancellation

The subscription is taken out for an indefinite period, billed monthly, and automatically renews on each billing date.

The user may cancel their subscription at any time from their "Account" area (Stripe billing portal), free of charge and without justification. Cancellation takes effect at the end of the period already paid for: access remains active until that date, after which the account automatically reverts to the free plan.

No pro-rata refund is given for a period that has already started, except where otherwise required by law.

Article 5 — Right of withdrawal

Under Article L221-18 of the French Consumer Code, any consumer has a 14-day period to exercise their right of withdrawal on a distance purchase.

However, under Article L221-28 13° of the French Consumer Code, this right does not apply to the supply of digital content not provided on a physical medium whose performance has begun after the consumer's prior express consent and express waiver of their right of withdrawal — which subscribing online for immediate access constitutes.

Article 6 — Invoicing

An invoice is issued for each payment and remains available from the "Account" area (Stripe portal). These documents are kept in accordance with applicable accounting and tax obligations.

Article 7 — Service unavailability

In the event of a prolonged outage attributable to the publisher (excluding announced planned maintenance, or an outage of a third-party provider such as Supabase/Vercel/Stripe), the user may request a credit proportional to the length of the outage, by making a reasoned request to contact@spromptgenerator.com.

Article 8 — Complaints and mediation

For any complaint: contact@spromptgenerator.com. In accordance with Article L616-1 of the French Consumer Code, if a written complaint to customer service is unsuccessful, the consumer may refer the matter free of charge to an approved consumer mediator.

Article 9 — Governing law

These Terms of Sale are governed by French law.
